This Resolution takes effect concurrently with Law of Ukraine No. 877-V dated April 5, 2007 “On basic principles of governmental supervision (control) in the area of economic activity", which takes effect on December 25, 2007 with the exception of parts one and two of Article 5 (in effect since January 1, 2008).
This Procedure defines the mechanism of costs compensation by business entity (BE) for expert examination (testing) of product samples performed by governmental supervising (controlling) authority in connection with expert examination (testing) of product samples (hereinafter referred to as “expert examination’) in the event when findings of the expert examination confirm violation by the BE of applicable laws.
The governmental authority of supervision (control) should in one week period following the BE’s review of conclusion of the expert examination, which certifies a violation of legislation, prepare documents supporting the amount of costs incurred in result of such examination and submits them to the BE.
The BE, in its turn, within one week period since receipt of the aforementioned documents should compensate to the governmental authority of supervision (control) the costs related to the expert examination.
In case of disagreement by the BE with conclusions of expert examination, the governmental authority of supervision (control) can undertake second expert examination. If the results of second expert examination confirm the fact of legislation violation, the BE has to cоcompensate to the governmental authority of supervision (control)) all costs related to the first and second expert examination.
The funds received by the governmental authority of supervision (control) in result of expert examination shall be transferred to the State Budget.
The above costs shall be enforced in court if the BE rejects to compensate the costs related to the expert examination
